1. Acceptance of These Terms; the Parties
These Terms of Service (these "Terms") are an agreement between you and Pattern Engine LLC, a Kansas limited liability company, doing business as Pidgeon Health ("Pidgeon Health," "we," "us," or "our").
These Terms govern your access to and use of the "Account Services" — the cloud account, identity, billing, team-management, entitlement, and download surfaces we provide at account.pidgeon.health — and your purchase and management of subscriptions to the Pidgeon Health products described in Section 2. By creating an account, starting a trial, purchasing a subscription, or otherwise using the Account Services, you agree to these Terms. If you use the Account Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
If you do not agree to these Terms, do not use the Account Services.
2. Description of the Services
Pidgeon Health provides healthcare integration testing and interoperability tools:
- Desktop Apps: Post (test-message generation, validation, and delivery, including the Conform conformance module), Flock (schema-aware synthetic test data), Loft (interface content monitoring), and Migrate (FHIR Bulk Data migration), together with the Pidgeon launcher (collectively, the "Desktop Apps"). The Desktop Apps run on your device against a local engine and local sidecar service (the "Bridge"); healthcare message processing happens on your device. Use of the Desktop Apps is licensed under the End User License Agreement (the "EULA").
- CLI: the
pidgeoncommand-line tool (the "CLI"), licensed separately as free, open-source software under the Mozilla Public License 2.0. The CLI's free tier requires no account and no payment, and these Terms do not restrict rights granted by that open-source license. - Account Services: the
account.pidgeon.healthsurfaces described in Section 1, which hold account, billing, team, entitlement, and download data only. Healthcare message content is not processed by the Account Services. - Vendor Intelligence Network (the "Vendor Intelligence Network" or "VIN"): an aggregated, anonymous database of vendor-specific interface patterns, field population statistics, and validation characteristics, compiled from de-identified "Telemetry" contributed by the user network as described in the Telemetry & VIN Consent Notice. Vendor Intelligence improves validation accuracy and generation quality for all users.
The products generate synthetic test data and process healthcare messages for testing, development, and quality-assurance purposes.
3. Relationship to Other Agreements
The following are incorporated into these Terms by reference:
- the Privacy Policy;
- the Acceptable Use Policy (the "AUP");
- for the Desktop Apps, the EULA, which governs the software license itself; these Terms govern the account and billing relationship; and
- the Telemetry & VIN Consent Notice, which governs Telemetry and Usage Analytics consent and controls.
If you are a Founding Member, the Founding Member Program Terms supplement these Terms and control over any conflicting provision of these Terms for the perks they cover. If you have executed a Master Subscription Agreement or Order Form with us, that agreement controls over these Terms for the products it covers.
4. Account Registration
To purchase a subscription, manage a team, or use account-gated features of the Desktop Apps, you must create an account. You agree to:
- provide accurate and complete registration information;
- maintain the security of your account credentials;
- notify us immediately of any unauthorized access; and
- accept responsibility for all activity under your account.
5. Subscriptions, Trials, and Billing
5.1 Pricing Schedule
Subscription tiers, features, and prices for each product are as set forth in the "Pricing Schedule" published at pidgeon.health/pricing, or in an applicable "Order Form". These Terms state no prices; the Pricing Schedule in effect at the time of purchase or renewal governs.
5.2 Free CLI
The CLI is free and open-source under the Mozilla Public License 2.0. No account or payment is required. For the free CLI, both Telemetry (the VIN pipeline) and "Usage Analytics" (the product-usage analytics pipeline) are off; see the Telemetry & VIN Consent Notice.
5.3 Console Free Tier
The "Console Free" tier is the free account tier identified on the Pricing Schedule. It provides limited desktop-app capabilities (message viewing, basic validation, reference browsing) at no charge. The Console Free tier is offered in exchange for participation in the Vendor Intelligence Network through Telemetry collection, as described in the Telemetry & VIN Consent Notice and the telemetry provisions of the EULA. Telemetry activation, defaults, and your controls — including regional consent requirements — are governed by the Consent Notice. Disabling all Telemetry may restrict access to Console Free features. No credit card or payment is required for the Console Free tier.
5.4 Free Trial
New accounts receive a 14-day free trial of the Professional tier of Post as identified on the Pricing Schedule. No credit card is required to start a trial. When a trial ends without a paid subscription, the account reverts to the applicable free tier; we do not charge you at the end of a trial you did not convert. Founding Members receive an extended 30-day trial as a promotional exception under the Founding Member Program Terms.
5.5 Paid Subscriptions
Paid plans are billed monthly or annually as selected at checkout. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period, and you authorize recurring charges to your payment method at the then-current Pricing Schedule rate (or your locked promotional rate, where one applies) until you cancel. You are responsible for applicable taxes, which will be presented at checkout where we are required to collect them.
5.6 Cancellation
You may cancel your subscription at any time through the Account Services or by contacting support. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. After cancellation takes effect, the account reverts to the applicable free tier.
5.7 Refunds
Except as provided in Section 5.8 or required by applicable law, payments are non-refundable and no refunds or credits are provided for partial billing periods, unused time, or downgrades.
5.8 EU/UK Consumer Right of Withdrawal
If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days of purchase without giving a reason.
- How to withdraw: notify us within the 14-day period by an unequivocal statement to legal@pidgeon.health (a model withdrawal statement is available on request). We will refund the payment received, using the original payment method, without undue delay and no later than 14 days after receiving your withdrawal.
- Subscription services: if you ask us to begin providing a subscription service during the withdrawal period and then withdraw, you owe us a proportionate amount for the service provided up to the time you told us of your withdrawal, and the refund is reduced accordingly.
- Digital content: for digital content supplied other than on a tangible medium, checkout will ask for your express consent to immediate supply and your acknowledgment that you lose the right of withdrawal once supply has begun. If you do not give that consent, supply begins after the withdrawal period ends.
This Section applies only where the statutory right exists and prevails over Section 5.7 to that extent.
5.9 Price Changes
We may change subscription prices by updating the Pricing Schedule with at least 30 days' notice to affected subscribers. Price changes take effect at the start of the next billing period after the notice period ends. Price changes do not apply to any rate protected by an active price-lock promotion (including the Founding Member price lock) for as long as that promotion's conditions remain satisfied.
6. Usage Limits
Each subscription tier includes specific usage limits for message generation, validation, and API calls. Current limits are displayed in your account settings. Usage beyond plan limits may result in temporary throttling until the next billing period or an upgrade to a higher tier.
7. Acceptable Use
Your use of the Account Services and the products is subject to the Acceptable Use Policy, which is incorporated into these Terms by reference. The AUP includes, without limitation, prohibitions on unlawful use, on processing real Protected Health Information outside the products' intended testing and staging uses, on production clinical decision-making, and on circumventing license gates or usage limits. We may suspend or terminate access for AUP violations as described in the AUP and Section 12.
8. Data Handling
8.1 Synthetic Data
Messages generated by the products use synthetic (fake) data. Generated content does not contain real patient information.
8.2 User-Provided Data
If you input messages for validation, de-identification, or analysis, you are responsible for ensuring you have the right to use that data. The Desktop Apps and CLI process messages on your device via the local engine and do not transmit message content to our servers, except for de-identified Vendor Intelligence Network Telemetry where it is enabled under the Telemetry & VIN Consent Notice.
8.3 De-Identification
The de-identification features implement HIPAA Safe Harbor methodology with synthetic replacement and run entirely on your device before any data leaves it. The de-identification engine removes the 18 HIPAA Safe Harbor identifier categories as they appear in standard HL7 v2, FHIR, and NCPDP message structures, with free-text edge-case scanning on the roadmap; the as-built coverage map is documented in De-Identification & HIPAA Safe Harbor. De-identification is provided as a tool to assist your compliance efforts and does not constitute a guarantee of HIPAA compliance.
8.4 Telemetry and Usage Analytics
Two separate, independently controlled pipelines exist, both governed by the Telemetry & VIN Consent Notice and the Privacy Policy:
- Telemetry (the VIN pipeline): interface-structure metadata and de-identified message templates contributed to the Vendor Intelligence Network. Telemetry is de-identified on your local device before transmission: the de-identification engine removes the 18 HIPAA Safe Harbor identifier categories as they appear in standard HL7 v2, FHIR, and NCPDP message structures, with free-text edge-case scanning on the roadmap (coverage map: De-Identification & HIPAA Safe Harbor). Telemetry is designed to exclude patient identifiers, raw field content, and your organization's identity.
- Usage Analytics (the product-usage pipeline): typed product-usage events — event names, counts, durations, and tiers — never message bodies.
Key points:
- For the free CLI, both pipelines are off.
- Defaults for other tiers, regional consent requirements, and your opt-out controls are stated in the Consent Notice; you may change your settings at any time (Console Free users: opting out of Telemetry may restrict Console Free features, per Section 5.3).
- Teams and Enterprise accounts have all Telemetry disabled by default, subject to administrator opt-in.
- Aggregated Telemetry contributes to the Vendor Intelligence Network, which improves the products for all users.
- Pidgeon Health may license aggregated, anonymous Vendor Intelligence data to third parties; no individual user's, patient's, or organization's data is identifiable in such outputs.
Telemetry leaves your device only via outbound HTTPS to our ingest endpoint (no inbound port is opened); the egress architecture is documented in VIN Aggregation & Egress.
8.5 PHI Prohibition
The Account Services are not designed or offered to receive Protected Health Information ("PHI"), and you must not upload, submit, or transmit PHI to the Account Services. Use of the Desktop Apps and CLI with real healthcare data is permitted only as described in the AUP and the EULA, on your own infrastructure and under your own compliance obligations.
9. Intellectual Property
9.1 Our Property
The Account Services, the Desktop Apps, and all associated software, content, and trademarks — excluding open-source components — are the intellectual property of Pattern Engine LLC. The Desktop Apps and the Pidgeon launcher are proprietary software licensed, not sold, under the EULA.
9.2 Open Source
The CLI and the Pidgeon.Core engine are licensed under the Mozilla Public License 2.0. Third-party open-source components are used under their respective licenses. See our open-source notice for details.
9.3 Your Data
You retain ownership of all data you input into the products. We claim no intellectual property rights over your messages, configurations, or generated outputs.
9.4 Vendor Intelligence Network
Aggregated, anonymous statistical data compiled from Telemetry contributions across the user network is the intellectual property of Pattern Engine LLC. Individual Telemetry contributions are compiled into statistical summaries; no individual user retains ownership of aggregated patterns. You retain the right to request deletion of your individual Telemetry contributions as described in the Privacy Policy.
10. Third-Party Services
The Account Services and products rely on third-party providers. Your use of these integrations is subject to their respective terms; the Privacy Policy describes the personal data each provider processes on our behalf.

11. Disclaimer of Warranties
THE ACCOUNT SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PATTERN ENGINE LLC DOES NOT WARRANT THAT THE ACCOUNT SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT GENERATED TEST DATA WILL MEET SPECIFIC REGULATORY REQUIREMENTS.
THE PRODUCTS ARE TESTING AND DEVELOPMENT TOOLS. THEY ARE NOT MEDICAL DEVICES, ARE NOT CERTIFIED AS MEDICAL DEVICES, AND MUST NOT BE USED FOR CLINICAL DECISION-MAKING OR PRODUCTION HEALTHCARE OPERATIONS.
Some jurisdictions do not allow the exclusion of implied warranties; where such exclusions are not permitted, they apply to the maximum extent permitted by law, and consumers retain any non-waivable statutory rights.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATTERN ENGINE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE ACCOUNT SERVICES OR PRODUCTS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, for consumers in certain jurisdictions, liability for death or personal injury caused by negligence or for fraud.
13. Termination
13.1 By You
You may terminate your account at any time by canceling your subscription and deleting your account through the Account Services.
13.2 By Us
We may suspend or terminate your account if you materially violate these Terms or the AUP, with notice when practicable, as described in the AUP's enforcement provisions. Upon termination, your right to use the Account Services ceases immediately.
13.3 Effect of Termination
Upon termination, your account data will be retained for 30 days to allow export, after which it will be permanently deleted in accordance with the retention schedule in the Privacy Policy. Sections that by their nature should survive termination — including Sections 8.4 (aggregated Telemetry already contributed), 9, 11, 12, 15, and 16 — survive.
14. Modifications to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Account Services after changes take effect constitutes acceptance. If you do not agree to a change, you may cancel under Section 5.6 before the change takes effect.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms shall be brought exclusively in the state and federal courts located in Kansas, and each party consents to the personal jurisdiction of those courts. If you are a consumer, this Section does not deprive you of the protection of mandatory consumer-protection provisions, or the jurisdiction of the courts, of your country of residence where applicable law grants them.
16. General
- Entire agreement: these Terms, together with the documents incorporated by reference in Section 3 and any executed Order Form or Master Subscription Agreement, are the entire agreement between you and us regarding the Account Services.
- Assignment: you may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Severability: if any provision is held unenforceable, the remainder continues in effect.
- No waiver: failure to enforce a provision is not a waiver of it.
- Notices: we may provide notices via email to your registered address or through the Account Services.
