1. Scope and Acceptance

These Website Terms of Use (these "Website Terms") govern your access to and use of the marketing and informational websites operated by Pattern Engine LLC, a Kansas limited liability company, doing business as Pidgeon Health ("Pidgeon Health," "we," "us," or "our") — including pidgeon.health and its product subdomains (such as post.pidgeon.health, flock.pidgeon.health, loft.pidgeon.health, and migrate.pidgeon.health) (collectively, the "Site"). By using the Site, you accept these Website Terms.

These Website Terms cover the Site only. The products themselves — the desktop applications, the CLI, and the account, billing, and subscription services at account.pidgeon.health — are governed by the Terms of Service and, for the desktop software, the End User License Agreement, not by these Website Terms.

2. Informational Content; No Reliance

The Site provides general information about Pidgeon Health products. Site content — including product descriptions, capability statements, documentation excerpts, blog posts, and benchmark or conformance figures — is provided for general informational purposes, may describe capabilities as of a stated point in time, and may change without notice.

Nothing on the Site is legal, regulatory, compliance, clinical, or professional advice, and Site content is not a substitute for your own professional advisers. Statements about healthcare standards, HIPAA, or regulatory mandates (such as CMS-0057-F) describe our products' capabilities and the general regulatory landscape; they are not advice about your obligations. You should not rely on Site content as the basis for compliance, procurement, or clinical decisions.

3. Intellectual Property in Site Content

The Site and its content — text, graphics, logos, page designs, and the "Pidgeon Health," "Post," "Flock," "Loft," "Migrate," and related marks — are the property of Pattern Engine LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to access and view the Site for your own informational use. Except for that license, no rights in Site content are granted. Open-source components of our products are licensed under their own terms (see the open-source notice); nothing in these Website Terms limits rights granted by those licenses.

You may quote brief excerpts of Site content with attribution. You may not scrape the Site at disruptive volume, republish substantial portions of it, or use our marks in a way that suggests affiliation or endorsement without our written permission.

4. Acceptable Use of the Site

You must not:

  • use the Site for any unlawful purpose;
  • probe, scan, or test the vulnerability of the Site without authorization (good-faith security research reported to security@pidgeon.health under our responsible-disclosure process is authorized, per the Acceptable Use Policy § 3);
  • interfere with or disrupt the Site or its infrastructure, or impose an unreasonable load on it;
  • introduce malicious code; or
  • misrepresent your affiliation with any person or entity in communications through the Site (including waitlist and contact forms).

5. Third-Party Links

The Site may link to third-party websites, documentation, standards bodies, and services. Those sites are not under our control; we are not responsible for their content, accuracy, or practices, and a link is not an endorsement. Your use of third-party sites is at your own risk and subject to their terms.

6. Copyright Complaints

We respond to notices of alleged copyright infringement in accordance with our Copyright / DMCA Policy. To submit a notice or counter-notice, follow the procedures there.

7. Cookies and Analytics

The Site's use of cookies and similar technologies — including PostHog analytics and Cloudflare operational cookies — is described in the Cookie & Tracking Notice. Personal data collected through the Site is handled as described in the Privacy Policy.

8. Disclaimer and Limitation of Liability

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATTERN ENGINE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE.

Nothing in these Website Terms excludes liability that cannot be excluded under applicable law.

9. Governing Law and Venue

These Website Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Any dispute arising from these Website Terms shall be brought exclusively in the state and federal courts located in Kansas.

10. Changes

We may update these Website Terms from time to time by posting the updated version on the Site with a revised effective date. Continued use of the Site after an update constitutes acceptance.
